Lactalis Summer Salad Consumer Contest Official Rules

THE FOLLOWING CONTEST IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. ENTRY PERIOD:

Lactalis would like you to share your favorite summer salad recipe including President® Feta (chunk, crumble, fat free, flavored or spreadable) or Mozzarella Fresca™ fresh mozzarella cheese in the Lactalis Summer Salad Contest ("Contest") starting on June 15, 2009 at 12:00:01 a.m. Eastern Time (“ET”) and ending on August 15, 2009 at 11:59:59 p.m. ET (“Entry Period”).

2. ELIGIBILITY:

Contest is only open to legal residents of the (50) United States and District of Columbia who are 18 years of age and older at time of entry. Employees of Lactalis Deli, Inc. (“Sponsor”), its parent, affiliates, subsidiaries, grocers/retailers, advertising and promotion agencies, including Eric Mower and Associates, and each of their immediate family members (spouse, parents, children and siblings, and each of their spouses, regardless of where they live) and persons living in the household of each of these individuals, whether related or not are ineligible. Void where prohibited. Contest is subject to all applicable federal, state and local laws and regulations.

3. HOW TO ENTER:

During the Entry Period, visit either www.PresidentSaladContest.com or www.MozzarellaFrescaSaladContest.com (together the “Contest Website”). Complete the registration with the required information, including where you shop for President® and/or Mozzarella Fresca™ products (or just tell us your local grocer); then submit your favorite original summer salad recipe in which you use Président® Feta (chunk, crumble, fat free, flavored or spreadable) or Mozzarella Fresca™ fresh mozzarella, as an ingredient. Recipe should include its name, the list of ingredients, and preparation instructions ("Recipe"). You may, at your discretion, upload a photo of your prepared Recipe, however, the photo is not required for entry (of course those Recipes that are accompanied by a photo may be more likely to receive votes.) (Recipe and photo, "Entry"). Once you complete your Entry, you will receive an ID number and a link to your Recipe so that you can share your Recipe with family and friends. All entries must be received by Sponsor no later than 11:59:59 p.m. ET on August 15, 2009. Limit one Feta and one fresh Mozzarella Entry per person/household. Multiple entries received per person or per household, including multiple entries by the same entrant using different email addresses, will result in disqualification of the entrant and invalidate all entries submitted by that entrant for the entire Entry Period. Should multiple users of the same e-mail account enter the Contest and a dispute thereafter arise regarding the identity of the entrant, the authorized subscriber of said e-mail account at the time of entry will be considered the entrant. “Authorized Account Subscriber” is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Entries become the property of the Sponsor and will not be returned. Please see the Sponsor's privacy policy at www.PresidentSaladContest.com or www.MozzarellaFrescaSaladContest.com for details of our policy regarding the personal information collected in connection with this Contest.

4. (50) PRIZES:

A $500 gift card for the grocer/retailer listed on your Entry (or a substitute of equal or greater value in Sponsor's discretion if grocer/retailer does not sell gift cards). Gift cards are valid to the terms and conditions of the retailer and may not be valid for certain purchases. Total Value of all prizes $25,000. Unclaimed prizes will not be awarded. Prizes are non-transferable and no substitutions or cash redemptions will be made. In case of unavailability, Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value. All taxes on prizes are sole responsibility of winner. Limit one (1) prize per person/family/household/cheese type.

5. VOTING DETAILS:

All Recipe entries received will be posted together on Sponsor's Contest Website for voting by the consumer public. Starting at 12:00:01 a.m. June 15, 2009 through 11:59:59 p.m. August 23, 2009 ("Voting Period"). Consumers are invited to visit the Contest Website and vote for the Recipe they think sounds most appealing. There is a limit of one vote per person/household/email address per day. Any attempt by entrant and/or his or her family or friends to vote more than the number of times authorized herein using multiple names or email addresses and/or any other fraudulent mechanism, as determined by Sponsor in its sole discretion, shall give Sponsor the right to disqualify entrant in its reasonable discretion. The fifty (50) Recipes, from amongst all eligible Feta and Mozzarella recipes submitted which receive the most votes during the Voting Period will receive a prize. In the unlikely event of a tie, the tie will be broken via an additional voting period by the consumer public as among tied entrants for additional voting period starting at 12:00:01 a.m. August 24, 2009 through 11:59:59 p.m. August 28, 2009 ("Additional Voting Period"). Voting limits as set forth above apply. The tied entrants recipe which receives the most votes during the Additional Voting Period (if any) will receive a prize.

6. WINNER NOTIFICATION:

The Winners will be confirmed by U.S. mail, e-mail and/or telephone on or about August 28, 2009 and must meet all eligibility requirements including the timely execution and return of all necessary releases and documents required by Sponsor. Sponsor is not responsible for any change of email, mailing address and/or telephone number of entrants. Winners may be required to execute an Affidavit of Eligibility, a Liability Release and, except where prohibited by law, a Publicity Release, and return those items within ten (10) business days of issuance of notification. Noncompliance within this time period or failure of a potential Winner to respond to a notification attempt within ten (10) days of such attempt may result in disqualification and, at Sponsor's sole discretion, an alternate winner may be selected. If: (i) any prize or prize notification is returned as undeliverable, (ii) a potential Winner declines his or her prize, (iii) a potential Winner fails to comply with any of the Official Rules as outlined herein, such potential Winner will be disqualified and an alternate Winner will be selected at the Sponsor's sole discretion. Prizes won by minors in their state of residence may be awarded to a parent or legal guardian who would be required to sign all required documentation.

7. CONTEST TERMS:

BY SUBMITTING AN ENTRY, ENTRANT ACKNOWLEDGES THAT HIS/HER ENTRY MAY BE POSTED ON SPONSOR’S WEBSITE, IN SPONSOR’S DISCRETION. Submission of an Entry grants Sponsor and its agents an unlimited, worldwide, perpetual, license and right to publish, use, publicly perform the Entry in any way, in any and all media, without limitation, and without consideration to the entrant. By accepting prize, winners further agree to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in the Entry, including, without limitation, all copyrights. Upon request of Sponsor, winners shall execute and deliver such additional instrument of assignment, as may be solely deemed by Sponsor, reasonably necessary to establish ownership of record of the right, title and interest in and to the Entry and of the copyrights transferred. Should Sponsor fail to request the said assignment as stated, that shall not be deemed a waiver of Sponsor's rights and Sponsor may at a later time request the assignment. Sponsor reserves the right to alter, change, or modify the winning entries, in its sole discretion. Entries: 1) must be the original work of the entrant; 2) may not have won previous awards; 3) may not have been published previously; 4) must not infringe any third party rights, including any third party trademark or copyright; 5) must be suitable for publication (i.e., may not be obscene or indecent; and 6) you must have obtained permission and a signed release from any person/logo/property featured in photo portion of Entry. Any such entrant will indemnify and hold harmless, Sponsor, and Releasees (as defined below) from any claims to the contrary. Any entrant whose work includes likenesses of third parties or contains elements not owned by the entrant (such as, but not limited to, depictions of persons, buildings, trademarks or logos) must be able to provide legal releases for such use including Sponsor's use of such Entry, in a form satisfactory to administrator, upon request, prior to award of prize. By submitting an Entry, entrants agree that their submission is made in consideration of the entrant being permitted to participate in the Contest and is made without restriction; will not place Sponsor under any obligation; and that Sponsor is free to disclose or otherwise disclose the ideas contained in the entries on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to entrant. Entrant acknowledges that, by acceptance of his or her submission, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than entrant. By participating, entrants agree to: a) these Official Rules and the decisions of the Sponsor, which shall be final in all respects; and b) release, discharge, and hold harmless Lactalis Deli, Inc. and Eric Mower and Associates, each participating grocer, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies and each of their respective officers, directors, shareholders, agents and employees of the aforementioned entities (collectively “Releasees”), from any liability, claims or damages arising out of their participation in the Contest and the acceptance, use, misuse or possession of the prize, or Recipe submitted. By accepting the prize, winner (or winner’s parent/legal guardian in the case of an eligible minor) agrees to, where legal, Sponsors’ and its designees’ use of his/her name, city and state of residence and/or likeness for advertising and publicity purposes in any and all media now or hereafter known throughout the world in perpetuity without further compensation, permission or notification and, upon request, will provide consent to such use in writing. As a condition of entering the Contest, entrants agree that a) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; b) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees. Sponsor reserves the right, in its sole discretion to cancel or suspend this Contest, and randomly award the prizes from among all eligible entries received prior to action taken by Sponsor, should fraud, virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Contest. Sponsor reserves the right to modify or revise the Official Rules at any point during the Contest.

8. LIMITATION OF LIABILITY:

Sponsor is not responsible for lost, late, misdirected or incomplete or postage-due entries or for printing, typographical, human or other errors, problems or malfunctions relating to or in connection with the Contest, including without limitation, errors, problems or malfunctions which may occur in connection with the administration of the Contest or the announcement of the prizes. All entries become the sole property of Sponsor and none will be returned. No mechanically reproduced, illegible, incomplete, forged, software generated or other automated multiple entries will be accepted. Entries made by any other individual or any entity, and/or originating by any other mechanism, including but not limited to commercial Contest subscription notification and/or entering services, will be declared invalid and disqualified for this Contest. Sponsor is not responsible for any damage to an entrant’s computer system which is caused or occasioned by accessing the Official Website, participating in the Contest, or redeeming an online prize; for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connection, availability or accessibility problems arising in connection with or over the course of the Contest; for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; for any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error whether human, mechanical, clerical, electronic, or technical in nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of his or her Contest entries) who tampers with the entry process.

9. GOVERNING LAW:

By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of State of New York, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in New York, New York.

10. WHO WON:

To find out who won, mail a self-addressed, stamped envelope to: Lactalis Summer Salad Contest, P.O. Box7387, Prospect Heights, IL 60070-7387 for receipt by September 30, 2009. All requests will be fulfilled after the winner has been confirmed.
